Using The Law

The purpose of the law is to help us to protect our rights, and to ensure that we get justice and are safe on the streets. The idea is that we live in a democracy and that the law is to be used as a tool to facilitate our freedom and our right to live peaceful lives. It is not then a tool to be used for oppression and not something that we need to passively 'obey'. Just as we might find ourselves fined if we are seen to infringe on the law, so too can we use the law in order to get justice from others who have infringed our rights, and so too can we use the law in order to prove our innocence where necessary.

 However often the law is not seen this way, and is instead seen as 'the enemy'. This is often the case when we find ourselves getting traffic tickets for things like careless driving. This is seen as a 'one-way' transaction wherein we are being punished for breaking rules. In fact though, those punishing you are part of the same democracy and not actually 'superior' in any way. They are effectively a legal entity just like you and they are subject to the same laws. In some cases they make mistakes – perhaps for instance a subjective decision that you were engaging in careless driving when in fact you were perfectly safe. In these cases then you can turn the law back on them and use it just in the same way to protect yourself.

 The only problem with this is that we do not generally understand the same legal terms, nor know all of the laws regarding our situation. This leaves us believing that we are unable to combat the situation when we are wrongly convicted and leaves us believing that the law is something that happens to you, rather than something that you use and that can protect you. For instance, did you know that when a cop asks you if you 'understand' they are actually asking if you agree? Literally in legal term 'understand' means 'stand under' and that can be used against you. It is no one's fault that we don't understand these legal terms, but if we want to protect ourselves then it is our responsibility to learn to use them.

 At the same time though there are actually many laws and legal procedures that the police don't know either in the vast majority of cases. This then means that they can make mistakes when giving out traffic tickets that you can later use against them. For instance if they don't show a badge then this means they are not following through the correct procedure.

 Armed with the correct knowledge then it is possible to get out of things like traffic tickets and to avoid unnecessarily paying fines. As it stands most of us currently don't have the information necessary to combat these charges on a level playing field which is a big injustice and more of the law should certainly be taught in schools. However until it is, it is possible to get representation for fighting speeding tickets and the like.
